The case of Ms K

Our medical negligence team was approached by Ms K who required legal assistance following an unsatisfactory breast augmentation and mastopexy procedure requiring revision surgery.

Ms K had undergone the procedure hoping to achieve a fuller, more lifted appearance of her breasts. The surgeon advised that to achieve this, he would need to perform two different operations on each breast. This was the only procedure that was recommended to her, and she was given no other otions to consider.

After the procedure was carried out, Ms K told the surgeon that she was suffering severe pain. She also expressed her concern about a very uneven appearance between her breasts.

Following a number of follow-up appointments the surgeon recommended further surgery, telling Ms K that this would allow for her breasts to sit level. However, due to the Covid pandemic, the further surgery was never carried out.

Ms K was therefore left with deformed and painfully scarred breasts.

Making a successful No Win – No Fee medical negligence claim

We assessed her case and agreed to pursue a claim for compensation for negligent breast augmentation, working on a No Win, No Fee basis.

After obtaining expert evidence, the claim was presented to the surgeon. We argued that he had never made Ms K fully aware of the risks of the surgery, nor offered an alternative at any stage. We also alleged that had removed excessive breast tissue, and this had contributed to the severe pain.

Although the surgeon did not admit liability, he did agree to attend a formal mediation.

During the course of the mediation we were able to reach an out-of-court settlement with the surgeon. This resulted in Ms K receiving compensation of £40,000.
