Making a claim for compensation for delay in diagnosing prostate cancer
We have successfully recovered compensation on behalf of our client who sadly lost her husband, Mr X, following the delay in diagnosis of prostate cancer by his GP.
Background:
After Mr X had been experiencing concerns, he attended his GP in March 2016. A PSA blood test was performed, which recorded a raised result. In May 2016, a further PSA blood test was performed, and the results were noted as being borderline for prostate cancer by his GP.
However, there was a failure to investigate the results from both of these tests or refer Mr X to a specialist under the National Guidelines at the time.
There was a failure to repeat the blood tests quickly enough after May 2016, and a further test was not completed until February 2018. By this time, Mr X had been feeling more lethargic, nauseous, and had been experiencing weight loss. These concerns were highlighted to Mr X’s GP and following a repeat blood test in March 2018, which showed abnormal results, Mr X was referred to a specialist.
Mr X was diagnosed with terminal metastatic prostate cancer in May 2018 and sadly passed away.
The Claim:
Oliver Thorne, partner and head of our clinical negligence department, took this case on under our popular No Win, No fee funding arrangement.
He arranged for leading experts to comment on the standard of care provided to Mr X and their opinions were fully supportive of the claim.
A Letter of Claim was sent to the GP’s representative and after continuous negotiations, Oliver managed to agree on a settlement.
