We have successfully recovered compensation for a diathermy burn suffered by a woman who had undergone breast augmentation surgery with a cosmetic clinic.
What is a diathermy burn?
Diathermy is a surgical technique that uses the heat generated by electrical current to cut tissue or seal blood vessels.
Often burns occur when the diathermy is not applied to the skin properly or if the skin has come into contact with a spirit solution.
The facts of the case
Following our client’s breast augmentation surgery, she discovered a blister on her left breast. She was prescribed antibiotics and discharged.
Due to the lack of post-operative care from the clinic, a scab occurred which revealed a developing hole underneath.
She was reviewed by a plastic surgeon at the same clinic 5 months after surgery and was offered corrective surgery. Due to delays on the part of the clinic, 11 months after her initial surgery, our client underwent revision surgery at the clinic.
A formal investigation was undertaken by the clinic which concluded that our client’s diathermy burn was occurred while she was in theatre during her breast augmentation.
Our client received a complaint response from the cosmetic clinic group and she was offered a small amount of compensation. She therefore consulted our specialist team.
The diathermy burn compensation claim
Caroline Webber-Brown, who is a partner in our clinical negligence department, took this case on under our popular no win – no fee funding scheme. Caroline is recommended by The Legal 500 and the publication included this comment about her in a recent edition:
‘Having worked with Caroline Webber-Brown for years, I cannot think of a lawyer who better combines client care with utter devotion to their cause and to the fight on their behalves.’
After negotiations between Caroline and the clinic’s representatives, a compensation settlement of £9,000 was agreed
Our client was delighted with this figure as it was much more than what she had been offered prior to our involvement.
